Lkr
U.S. District Judge Vaughn Walker ruled on Wednesday that the California's Proposition 8 ballot initiative denying marriage rights to same-sex couples was unconstitutional, in a case that will almost certainly go all the way to the Supreme Court. Walker ruled that Proposition 8 is "unconstitutional under both the due process and equal protection clauses." The court, therefore, "orders entry of judgment permanently enjoining its enforcement." Two key sentences from the ruling: Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.http://nymag.com/daily/intel/2010/08/judge_vaughn_walker_hands_vict.html

Flash
If the people voted for this originally then there's no reason as to why this should be overturned. Whether its right or wrong, if this law passed with 52% of the vote it shouldn't be overturned.

I didn't know we ruled against the majority these days...If something is against the constitution, majority doesn't matter. It is taking away basic human rights. The people that voted to pass the first law should have voting privileges revoked. What does allowing people to marry do to others negatively? And since you obviously missed government class, majority does not rule in this country. It is not a democracy. EastCoastNiner
I don't think the main problem is necessarily that gay marriage is going to be allowed, but the way it happened. First off, it's unconstitutional for the Supreme Court to make rulings like these and never should have had this power, but the system [expletive]ed it all up long ago. It just shows how stupid the liberals are. "Oh, let's put this proposition to a vote. Oh, damn, the people didn't want it, so lets force it through". That's downright pathetic. EastCoastNiner
Also, I saw this on another site, and it's so damn true. . "The thing that I find most interesting about this topic is that those who are first in line to defend marriage equality are also the same people who are first in line to push affirmative action, busing, XYZ scholarships, or any other race/gender program in government. If everyone should be treated equally then everyone should be treated equally. Just a observation." OWNED!
Lkr
race scholarships have nothing to do with marriage. way to change the subject like you always do though, ECN. Did you know that majority were in favor of Jim Crow laws? Majority was in favor of slavery? Still doesn't make it right. This country is not a democracy, and is not ruled by the majority. The popular vote does not win the presidential election in case you didn't know. Denying marriage to gays prohibits them from marriage benefits, which they do deserve. Give me one good reason why marriage should be banned for gays. Edited August 5, 2010 by Lkr

Saying that people who generally want gay marriage are the same ones that push for affirmative action does make sense. They want equal rights for one group, but not equal rights for another. . Also, read the U.S. Constitution, and you'll realize your comparisons doesn't make too much sense, and going by the Constitution gay marriage is not allowed, and should only be over-turned if the people vote for it. They push for Affirmative Action to try overcome the racism and discrimination shown by a lot of businesses. Yes AA does have it's flaws but it wouldn't be necessary if there weren't some many [expletive]s in America. By wanting jobs for a minority is wanting equal rights, nice attempt at a funny. @ anyone who deny gay marriage? Really why do you want to deny people happiness? Does it really matter of effect you? Really really pathetic.

However, I am against having a SINGLE judge decide the outcome, AFTER the state put it to a vote and most people didn't support it.

EastCoastNiner
This country is not a democracy, move to one if you want popular vote to rule You have a lot of learning to do. I don't need you to tell me that we're a "republic" and not a democracy because I know very well what we are, but this country instills democratic principals. There's these things called laws in case you haven't heard. There are votes for a REASON. Hence, why when more people vote for a candidate in a certain state, more electoral votes are awarded to the winner, but no, you're right, popularity never matters. . In 50 years, people are going to sit back and seriously wonder what the [expletive] is wrong with liberals. They think with their heart and not their brain. I hope Obama is enjoying all of the vacations he's been taking this year too. That guy is a moron.

Thank god for the popular vote, the people always know what is right! In all honesty, this isn't something that should be voted on. It is human rights. Of course the majority is going to oppress the minority, it happens in EVERY situation.

Herbert Hoover led us into the GD, Jim Crow Laws, and southern racism led by republicans. if you actually look, the more liberal states are always the ones to make the greatest advancements first, with the republican states catching on later (civil rights, laws, etc.)
