California Senate Bill 1449 Signed Into Law

California Governor, Arnold Schwarzenegger signed Senate Bill 1449 into law late Thursday, September 30th, giving weary activists a collective, whew! The outgoing Governor of California’s actions have made the crime of possession of a small amount of marijuana no more damaging to one’s life than a simple traffic infraction. The bill was introduced in April by Senator Mark Leno and reduces the charges for adult marijuana possession of less than an ounce from a criminal misdemeanor to a civil infraction. SB 1449 amends the California Health and Safety Code so that the adult possession of up to 28.5 grams of marijuana is classified as an infraction and punishable by no more than a $100 fine. It eliminates a court appearance, court costs and most importantly, an adult caught with less than an ounce of marijuana will have no criminal record. The state is estimated to save millions of dollars in court cost by keeping minor marijuana offenders out of court.
