Getting arrested for a DUI? No reason to search the phone. What are you looking for? Steal something? Most definitely, yes. Running from the cops? Yes. I mean, if the cop has reason to look for information that can be related to the arrest, then so be it...but otherwise, I don't get why this would be allowed without the warrant.
