I get what both Lkr and Tru are getting at, but I would have to agree with Lkr more because imo it crosses the line of privacy wether you are under arrest or not. If they are over suspicious of you then a warrant should be asked for before search, after all thats what warrants are for.

I think they should be more specific, and define instances where this can be put into play.

 

Getting arrested for a DUI? No reason to search the phone. What are you looking for?

 

Steal something? Most definitely, yes.

 

Running from the cops? Yes.

 

I mean, if the cop has reason to look for information that can be related to the arrest, then so be it...but otherwise, I don't get why this would be allowed without the warrant.
